1. Acceptance of Terms

By accessing or using BetterUs ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

BetterUs is a habit tracking application designed for couples. The Service allows users to:

Create and track personal and shared habits
Connect with a partner for joint accountability
Send encouragement messages ("nudges") to partners
View progress statistics and streaks
Access premium features through subscription

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your password
Promptly update your account information if it changes
Accept responsibility for all activities under your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Partner Connection

The Service allows you to connect with one partner at a time. By connecting with a partner, you consent to sharing:

Your shared and "together" habit information
Your habit completion status
Nudge messages and encouragements
Basic profile information (name, profile picture)

You may disconnect from your partner at any time through the app settings.

5. User Responsibilities

You agree to use the Service only for lawful purposes. You must not:

Use the Service for any illegal or unauthorized purpose
Harass, abuse, or harm another person through the Service
Impersonate any person or entity
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any part of the Service
Use automated systems or software to extract data from the Service
Transmit viruses, malware, or other harmful code

6. Prohibited Conduct

The following conduct is strictly prohibited:

Using nudges or messages to harass or control your partner
Creating fake accounts or connecting with partners without consent
Sharing inappropriate, offensive, or harmful content
Attempting to reverse engineer or copy the Service
Selling or transferring your account to another person

7. Intellectual Property

The Service and its original content, features, and functionality are owned by BetterUs and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create within the Service (habit names, custom nudge messages, etc.), but you grant us a license to use this content to provide and improve the Service.

8. Subscriptions and Payments

8.1 Free and Premium Plans

BetterUs offers a free plan with limited features and a Premium subscription with additional features. Premium subscription prices are displayed in the app and may vary by region.

8.2 Billing

Premium subscriptions are billed through your Apple App Store or Google Play Store account. By subscribing, you agree to the payment terms of the applicable platform. One subscription provides Premium access for both you and your connected partner.

8.3 Free Trial

We may offer a free trial period for Premium features. At the end of the trial, you will be automatically charged unless you cancel before the trial ends. You can cancel your subscription at any time through your device's app store settings.

8.4 Refunds

Refunds are handled according to the policies of the Apple App Store or Google Play Store. We do not directly process refund requests. Please contact the respective platform for refund inquiries.

8.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until then.

9. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in prohibited conduct.

You may delete your account at any time through the app settings. Upon termination:

Your access to the Service will cease immediately
Your personal data will be deleted according to our Privacy Policy
You will lose access to any remaining subscription period (no refunds)
Your partner connection will be automatically dissolved

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The Service will be uninterrupted, timely, secure, or error-free
The results obtained from using the Service will be accurate or reliable
Any errors in the Service will be corrected

BetterUs is a habit tracking tool and does not provide medical, psychological, or relationship advice. The Service is not a substitute for professional help.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, or goodwill
Service interruption or computer damage
Any damages arising from your use of the Service
Any relationship issues between you and your partner

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless BetterUs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BetterUs operates, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms in the app and on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BetterUs regarding the Service and supersede any prior agreements.
